Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the TheGro platform operated by REESTOCK Sp. z o.o.
1. Acceptance of Terms
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
2. Description of Service
TheGro is a comprehensive Order Management System (OMS) and Warehouse Management System (WMS) platform that enables businesses to manage orders, inventory, shipments, and integrations across multiple sales channels.
3. Accounts
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account. You are responsible for safeguarding your password and for any activities under your account.
4. Subscription and Payments
Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis. Billing cycles are set on a monthly or annual basis. Your subscription will automatically renew unless you cancel it or we terminate it.
5. Usage-Based Pricing
Our pricing is based on workflow step executions. You agree to pay for all executions that occur within your account, including overage charges for executions exceeding your plan's included amount.
6. Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of REESTOCK Sp. z o.o. and its licensors. The Service is protected by copyright, trademark, and other laws.
7. User Content
You retain all rights to the data and content you upload to the Service. By uploading content, you grant us a license to use, store, and process that content solely for the purpose of providing the Service to you.
8. Prohibited Uses
You may not use the Service for any illegal purposes, to violate any laws, to infringe upon intellectual property rights, to harass or abuse others, to submit false information, to upload malicious code, or to interfere with security features.
9. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
10. Limitation of Liability
In no event shall REESTOCK Sp. z o.o., its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses.
11. Disclaimer of Warranty
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes shall be resolved by the competent courts in Warsaw, Poland.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
